Framework Act on
Administrative Regulation

Framework Act on Administrative Regulation is the framework act on regulatory reform of the government it and aims to improve quality of life of people and to pursue continuous improvement of national competitiveness by promoting autonomy and creativity in social and economic activities.

This Act consists of a total of 5 chapters and 38 articles and regulates basic matters on regulatory reform of the government including definition of regulations, scope of regulation, regulations registration system, examination of new or reinforced regulations, and systematic arrangement of existing regulations. In addition, the Regulatory Reform Committee has been installed under the Office of the President to deliberate and adjust government's regulatory policies and to examine and arrange regulations.

With regard to new and reinforced regulations, the head of central administrative agency should prepare written analysis on effects of the regulations and submit it for examination of the Regulatory Reform Committee under this Act. With regard to existing regulations, the head of central administrative agency should collect opinions of the persons concerned and relevant experts, select and arrange existing regulations requiring improvement or abolition. The Regulatory Reform Committee shall gather regulatory arrangement plan of each central administrative organization every year, establish a total plan for existing regulatory arrangement and receive reports on the results.

Anyone can submit opinions for improvement or abolition of existing regulation to the Regulatory Reform Committee, which will examine the opinions submitted and consider improvement or abolition of existing regulation. This Act was first enforced on Mar. 1, 1998. While there were two small revisions in 2006 and 2013, original institutional framework has been maintained and evaluated to reinforce legal foundation of regulatory reform.

Korean government has worked on fully revising the Framework Act on Administrative Regulation for the past 17 years to improve quality of regulations and to make regulatory reform more relevant to the citizens. The Regulatory Reform Sinmungo and Cost-in, Cost-out which are currently being operated will also be part of the reform.
